CAN A GOVERNOR OR MAYOR BE CHARGED FOR INTENTIONALLY DEPRIVING CITIZENS OF THEIR CONSTITUTIONAL RIGHTS TO LIFE, LIBERTY AND THE PURSUIT OF HAPPINESS UNDER TITLE 18 SECTION 242 USC ...HE SWORE TO PROTECT, PRESERVE AND DEFEND!
T 18 S242 USC ... “Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death”.
Title 42, Section 1983 of the U.S. Code addresses civil recourse by allowing individuals to sue state and local government officials for violations of their federal constitutional rights...Life Liberty and the Pursuit of Happiness! It provides a legal mechanism for individuals to seek redress when their rights have been deprived by someone acting “under color of state law.”
While every governor must pledge to support both the U.S. Constitution and their respective state’s constitution, the specific wording and requirements of the oath are defined by each state’s own laws. Somewhere in their charters there must be a way to impeach and charge for not doing their jobs, especially when lives and properties worth hundreds of millions are lost.
Despite the differences, oaths for protecting the citizens MUST be taken by every governor and mayor of every state and that includes to Protect, Preserve, Defend our INALIENABLE Rights to Life, Liberty, and the Pursuit of Happiness! THAT’S the Bill of Rights...folks...the first ten Amendments to the Constitution! Inaction can be as criminal as not reporting income!
I’m not an attorney, although there was an instance when a Federal Judge commended me on a case referred to the 2nd Circuit on appeal where I was correct and the defense attorney was wrong. It was ruled in favor of the FBI, yours truly, and verdict of guilty as charged on all counts. Judge Curtin was pleased!
I believe that any public official who intentionally turns their back, refuses...does nothing... for a situation they absolutely can intervene and save life/property ... where 100’s ...1,000’s of citizens lives are in danger, and not provide the lifesaving assistance requested, because he/she just doesn’t want to ...it’s their DUTY. They should be charged with several different crimes.
I am certain if Title18 USC does not apply...some other charge must cover... Federal Law MUST apply to get bums like Newsom or JB Pritzker!
What we must do to stop the riots cold is to arrest and INTERVIEW them to find the ringleaders ...how did you get here, who paid you, how much, where did you get the signs? Flip them into informants!
The President must use his power by executive order, set a rule of 3...
- declare an area a riot and closed to everybody... process them, print and photograph and charge with disobeying lawful order mandatory, 30 days in jail and $1,000 fine
- declare, by executive order, no masks, face covers, no hats, no hoodies, includes all Muslims. Don’t like it …GET OUT! Should they try to regroup ...lock them up, no masks of any type nor hoodies or hats allowed!
- do not allow any rocks, rockets, firebombs to be thrown at anyone especially lawmen ...shoot the responsible party...WITH REAL BULLETS...rocks kill. I don’t mean those rubber bullets either. A friend of mine, a Deputy US Marshall, was in riot gear, and some asshole threw a brick, hit him in the face, and killed him...wife and kids. It was over 50 years ago for me ...but I’ll never forget that. If some fat ass politician says you can’t do that, ask him if he’ll stand 10ft away from you and let you throw a brick at his face!
Muslims use stones to kill their worst enemies. They are called Kafirs, traitors. They use rocks because it a very painful death...I watched a video of them do it to some Muslim woman... brutal...I’d rather be shot...that’s hot...but not rocks!
